This was an action commenced on February 20, 1948 by Riley Frye, plaintiff, against Arthur Theige, Harlan Williams, and Milwaukee Automobile Insurance Company, a Wisconsin corporation, defendants, to recover damages for injuries sustained in a collision between an automobile driven by plaintiff and one owned by defendant Arthur Theige, driven by defendant Harlan Williams with Theige's consent and insured by Milwaukee Automobile Insurance Company. Defendant Theige filed a cross-complaint against Williams and the Milwaukee Automobile Insurance Company alleging that he was injured by the negligence of Williams; that Williams was an additional insured under the policy issued to Theige and that the insurance company was liable to Theige under the terms of the policy. The Milwaukee Automobile Insurance Company answered the cross-complaint setting up exclusions of the policy as a plea in bar and thereafter moved for summary judgment dismissing the cross-complaint. On April 21, 1948 the court entered an order denying the motion for summary judgment. Defendant insurance company appeals. Such further facts as are necessary for an understanding of the issues will be set out in the opinion.
